Home Business Regulations for Coffee Sales in the RA District
Coffee roasting and brewing is allowed in the RA district as a home business if the coffee is produced on-site. The operation requires an Administrative Development Permit and is strictly limited to 6 vehicle round-trips per day. Additionally, the business must not generate odors or fumes detectable off-site and must comply with all health and safety standards for food preparation.
In Nevada County, selling coffee that is brewed or roasted on-site is an allowed activity within the RA (Residential Agricultural) zoning district, provided the operation adheres to the standards for "Home Businesses." Under the county's allowable land use table, home businesses are permitted in the RA district subject to zoning compliance and applicable permit issuance [Section 12.02.021, Table 12.02.210.B].
Permit Requirements
While some home-based activities like office uses or arts and crafts are exempt from permit requirements, a coffee-related business (roasting or brewing) does not fall under these exemptions. Consequently, the following applies:
- Administrative Development Permit: An Administrative Development Permit is required for the operation [Section 12.03.110.B].
- Health and Safety Compliance: All home businesses must comply with local and State agency regulations, including Health and Safety standards and the California Retail Food Code for the handling of food products [Section 12.03.110.B.12; Section 12.03.030.C.5.e].
Operational Standards for Coffee Production
To qualify as a home business, the sale of coffee must meet specific "on-site" production and environmental criteria:
On-Site Production
The business is limited to selling or delivering articles that are produced on-site [Section 12.03.110.B.6]. Roasting green beans into finished coffee or brewing coffee on the premises would satisfy the requirement that the product be produced on the property.
Odors and Fumes
A critical restriction for coffee roasting is the control of emissions. The zoning code prohibits any equipment or process that generates "off-site, detectable... fumes [or] odors" [Section 12.03.110.B.11]. If the roasting process produces aromas detectable beyond the property line, the business would be in violation of home business standards.
Customer Traffic and Parking
The business must remain incidental and subordinate to the use of the property as a residence [Section 12.03.110.B.4].
- Traffic Limits: No more than six (6) business-related vehicle round trips are permitted per day. These trips must occur between 8:00 a.m. and 5:00 p.m., Monday through Saturday [Section 12.03.110.B.7].
- Parking: All business-related parking must be provided on-site [Section 12.03.110.B.8].
Facility and Signage Constraints
- Floor Area: The business cannot occupy more than 25% of the dwelling unitβs floor area or 400 square feet, whichever is greater. If conducted in an accessory building, the business area cannot exceed 1,000 square feet [Section 12.03.110.B.4].
- Appearance: The business must not alter the residential appearance of the premises [Section 12.03.110.B.5].
- Signage: One on-site, non-illuminated, freestanding or wall sign is allowed, limited to a maximum of four (4) square feet [Section 12.03.110.B.9].
