Selling Coffee at Agricultural Facilities in the RA District
In Nevada County's RA district, you can sell bottled or prepackaged coffee at a Farm Stand, provided the parcel is 3-5 acres. To sell freshly brewed or prepared coffee, you must obtain a Community Events Permit from the Department of Environmental Health and operate adjacent to a Certified Farmers' Market. Field Retail Stands are restricted to fresh produce and may not sell coffee.
In Nevada County, the ability to sell coffee within the Residential Agricultural (RA) zoning district depends on the specific type of agricultural facility you are operating and the manner in which the coffee is packaged or prepared.
Farm Stands vs. Field Retail Stands
The zoning code distinguishes between different types of retail outlets located on agricultural land.
Farm Stands
A Farm Stand is permitted in the RA district and is allowed to sell a broader range of products than a field retail stand. According to the code, a farm stand may sell:
- Non-potentially hazardous prepackaged food products from an approved source [§ 12.03.030.B.6].
- Bottled water or soft drinks [§ 12.03.030.B.6].
- Processed Agricultural Products, provided they are made with ingredients produced on or near the farm [§ 12.03.030.B.6].
If the coffee is prepackaged (such as bags of beans or ground coffee) or sold as a bottled beverage (bottled cold brew), it generally fits the criteria for a Farm Stand.
Field Retail Stands
A Field Retail Stand is significantly more restricted. These stands are limited to selling only fresh, farm-produced fruits, vegetables, nuts, and shell eggs grown by the producer on or near the site [§ 12.03.030.B.5]. Selling coffee—whether brewed or packaged—is not permitted at a Field Retail Stand.
Prepared Coffee and Community Events
The code treats "prepared foods," which explicitly includes coffee, differently than prepackaged goods.
Certified Farmers' Markets (CFM)
While a Certified Farmers' Market is primarily for the sale of agricultural products directly from producers, the code allows for the sale of prepared foods like baked goods and coffee under specific conditions:
- Permit Requirement: Sale of prepared coffee requires a separate Community Events Permit issued by the County Department of Environmental Health [§ 12.03.030.C.5.e].
- Location: The "Community Event" (where the coffee is sold) can occur adjacent to, but cannot be a technical part of, the certified farmers' market itself [§ 12.03.030.C.5.e].
Requirements for RA Zoning District
If you intend to operate a Farm Stand or host agritourism activities in the RA district, you must meet specific site standards:
- Parcel Size:
- If the property has a "Rural" (RUR) General Plan designation, the parcel must be at least 3 acres [§ 12.03.030.C.3.a].
- If the property does not have a "Rural" designation, the parcel must be at least 5 acres [§ 12.03.030.C.3.b].
- These minimums may be reduced only with an approved Use Permit.
- Access and Road Maintenance: The property must have direct access to a publicly maintained road. If it does not, the owner must join or form a road maintenance district (such as a permanent road division or community service district) [§ 12.03.030.C.3.k].
- Parking: All parking must be provided on-site. Vehicles must be able to enter and exit the site without backing into a public road or right-of-way [§ 12.03.030.C.3.l].
- Hours of Operation: Farm stand operations are limited to daylight hours [§ 12.03.030.C.3.n].
Permits and Health Standards
All sales of agricultural or food products must comply with the California Retail Food Code. If you are selling processed agricultural food products or offering samples, you may be required to obtain a permit from the County Department of Environmental Health [§ 12.03.030.C.3.c].
