Setback Standards for the OX- Office Mixed Use District in Raleigh

Jurisdiction: RaleighCode Version: May 2024

Building setbacks in the City of Raleigh's OX- (Office Mixed Use) district are primarily determined by the specific building type chosen for development and the presence of any street frontages. Base primary street setbacks generally range from 5 to 10 feet, while interior side setbacks are often 0 or 6 feet, and rear setbacks range from 10 to 20 feet. These requirements are subject to modification if the property is designated with a specific street frontage or abuts a residential district.

Base Dimensional Setbacks in OX-

In the City of Raleigh, the OX- district allows several different building types, each with its own set of minimum setback requirements. These "Base Dimensional Standards" apply unless a property has a specific "Frontage" designation that overrides them.

Building Type Primary Street (Min) Side Street (Min) Side (Interior) (Min) Rear (Min)
Detached House 10' 10' 5' 20'
Attached House 10' 10' 5' 20'
Townhouse 10' 10' 10' (at site boundary) 20' (at site boundary)

Frontage-Specific Setback Overrides

Street Frontages in the City of Raleigh are applied to Mixed Use districts like OX- to mandate specific urban forms along the street edge. If a frontage is applied to a property, its setback and "build-to" requirements control over the base standards listed above [Section 3.4.1].

Frontage Type Primary Street Build-to (Range) Side Street Build-to (Range) Notes
-PK Parkway 50' (Min setback) N/A Intended for heavily landscaped buffers [Section 3.4.3]
-DE Detached Per Residential Infill N/A Maintains residential character [Section 3.4.4]
-PL Parking Limited Base Min to 100' Max 0' to 100' Allows limited parking between building and street [Section 3.4.5]
-GR Green 20' to 50' 20' to 50' Requires landscaped area between building and street [Section 3.4.6]
-UL Urban Limited 0' to 20' 0' to 20' Buildings abut the sidewalk [Section 3.4.7]
-UG Urban General 0' to 20' 0' to 20' Higher street wall continuity than -UL [Section 3.4.8]
-SH Shopfront 0' to 15' 0' to 15' Highest level of walkability; "main street" feel [Section 3.4.9]

Neighborhood Transition Requirements

When a City of Raleigh OX- district property immediately abuts a residential district (R-1, R-2, R-4, R-6, or R-10) that is vacant or contains a detached/attached house, "Neighborhood Transitions" apply to protect the lower-density area [Section 3.5.1].

Zone A: Protective Yard

This is a required buffer immediately abutting the residential district boundary line. No buildings or structures are allowed in this zone. The width varies based on the type of protective yard required (Type 1 is 10 feet, Type 2 is 20 feet, and Type 3 is 50 feet) [Sections 3.5.2, 3.5.3].

Zone B: Use Restricted

This zone extends from the edge of the Zone A protective yard to a point 50 feet from the residential district boundary line. Within this 50-foot area, only low-intensity uses such as surface parking, landscaping, or small accessory structures (max 14' height) are permitted [Section 3.5.4].

General Rules and Exceptions

  • Measurement: Primary and side street setbacks are measured perpendicular from the edge of the existing or proposed right-of-way, whichever is greater [Section 1.5.4.B].
  • Side/Rear "0' or 6'" Rule: For certain mixed-use building types, a 0-foot setback is allowed. However, if a setback is provided, it must be at least 6 feet to ensure adequate separation for maintenance and fire safety [Sections 3.2.4, 3.2.5].
  • Encroachments: Certain building features like porches, balconies, and chimneys may encroach into required setbacks by specified distances (typically 4 to 12 feet, provided they remain at least 3 feet from the property line) [Section 1.5.4.D].
  • Parking Setbacks: On-site parking must be located behind the applicable parking setback line. For most urban frontages in the OX- district, no on-site parking is permitted between the building and the street [Sections 1.5.5, 3.4.2].
