Specific Use Standards for Restaurants and Cafes

The City of Raleigh imposes additional requirements on "Eating Establishments" depending on the specific zoning district to ensure compatibility with surrounding neighborhoods.

Residential Mixed Use (RX-) Districts

Eating establishments in the RX- district must adhere to the following:

  • Location: The use must be located on the first floor of a corner unit within an Apartment building type.
  • Intersection Requirement: The building must be situated at the intersection of two public streets.
  • Floor Area: The use cannot exceed 4,000 square feet in gross floor area per lot.
  • Hours of Operation: Activities and deliveries are restricted to the hours between 6:00 AM and 11:00 PM.
  • Proximity to Residential: The building must be located at least 150 feet from any abutting Residential District (R-1, R-2, R-4, R-6, or R-10) [Section 6.4.10.C.2.a].

Office Mixed Use (OX-) Districts

Eating establishments in the OX- district must adhere to the following:

  • Building Type: The use must be located within or attached to a multi-tenant building; it cannot be located in a standalone building.
  • Floor Area: The use is limited to 15% of the gross floor area of the entire building or 4,000 square feet, whichever is greater.
  • Hours of Operation: Activities and deliveries are restricted to the hours between 6:00 AM and 11:00 PM [Section 6.4.10.C.2.b].

Bakery and Retail Sales Standards

Bakeries are classified under the "Retail Sales" use category as "baked goods" [Section 6.4.11.A.1]. In RX- and OX- districts, these are "Limited Uses" and must follow the same square footage and building placement standards as professional offices and personal services in those districts:

  • RX- Districts: Limited to 4,000 square feet per lot and must be in a corner unit of an apartment building [Section 6.4.11.D.1].
  • OX- Districts: Limited to 15% of the gross floor area or 4,000 square feet (whichever is greater) and must be in a multi-tenant building [Section 6.4.11.D.2].

Transit Overlay District (-TOD) Exemptions

For properties located within a Transit Overlay District (-TOD) in the City of Raleigh, certain limitations are relaxed to encourage density:

  • Eating establishments and retail sales units in the -TOD are not restricted to the 4,000 square foot maximum otherwise required in mixed-use districts, provided they are within or attached to a multi-tenant building.
  • The unit size can be increased up to 10,000 square feet in gross floor area [Section 6.4.10.C.2.v; Section 6.4.11.D.1.f].
