Zoning Variance Application Process in the City of Fort Worth

Administrative vs. Formal Variance

Administrative Approval

Decision and Expiration

Expiration

Once granted, a variance is not permanent until utilized. It will expire and have no further effect 180 days after approval unless [Section 3.404(a)]:

  • A building permit has been issued;
  • A certificate of occupancy has been issued; or
  • The development services director grants a one-time extension (maximum of 180 days) upon written request.

Appeals

Any person aggrieved by a decision of the Board of Adjustment may appeal by filing a petition in a court of record. This petition must be filed within 10 days of the board's decision and must specifically allege why the decision is illegal [Section 3.405].

Limitation on Reapplication

If the City of Fort Worth Board of Adjustment denies a variance proposal, the city will not accept new applications of a "like nature" for the same property for a period of 24 months from the date of denial. This mandatory delay may only be waived if the applicant describes substantially changed conditions in the community [Section 3.406].
