The Fayetteville Unified Development Code (UDC) allows for the continuation of uses and structures that were lawful before a code change but no longer comply with current zoning regulations. These "grandfathered" statuses are generally lost if a nonconforming use is abandoned for six consecutive months or if a nonconforming structure is damaged or destroyed to an extent exceeding 50% of its market value. Nonconforming Structures

A nonconforming structure is a building or activity that was lawful when established but fails to meet current City of Fayetteville requirements for its zoning district. [Section 151.01]

Maintenance and Reconstruction

The City of Fayetteville permits nonconforming structures to exist for continued creative reuse to maintain neighborhood character and diversity. Owners may perform repairs or minor reconstructions provided the nonconforming portion is not enlarged in footprint or volume. [Section 164.12(A)(1-2)]

If a nonconforming structure is damaged by natural disasters (fire, wind, etc.), the City of Fayetteville allows the owner to restore the structure on its original footprint. Limitations on Reconstruction

Change of Use

Abandonment

Under the Fayetteville UDC, a nonconforming use is considered abandoned if it is discontinued for six consecutive months. Nonconforming Lots

The City of Fayetteville allows for the development of lots that do not meet current width or area requirements (nonconforming lots) if they meet the following specific criteria:
