Definitions and Use Classification

The Fayetteville Unified Development Code (UDC) defines a Civic Building as a structure used primarily for public education, cultural performances, and religious organizations [Section 151.01]. Specifically, a "Church" is listed as an included use within Use Unit 4, along with other community-serving facilities like art galleries, cemeteries, libraries, and schools [Section 162.01].

Additionally, a "School and church facility" may be permitted as a temporary facility in an underdeveloped subdivision under a separate classification (Use Unit 2) via a Conditional Use Permit [Section 162.01].

Conditional Use Permit (CUP) Requirements

When a church is proposed in a district where it is a conditional use, the Fayetteville Planning Commission must make specific findings before the permit is issued. The Commission must certify that:

  • The use is empowered under the specific section of the code.
  • The granting of the use will not adversely affect the public interest.
  • Satisfactory provisions are made regarding ingress/egress, safety, off-street parking, and the control of noise, glare, or odors [Section 163.02].

Supplemental Regulations for Churches

Freestanding Bulletin Boards

Churches and religious institutions are allowed one (1) freestanding bulletin board on their campus to communicate information and events. These signs are subject to specific dimensional and setback requirements.

Regulation Type Standard
Maximum Area 10 square feet
Minimum Setback from Right-of-Way 15 feet
Maximum Area (with increased setback) 24 square feet
Expansion Provision 2 sq. ft. of area per 1 ft. of additional setback beyond 15 ft.

[Section 174.03]

Separation from Other Uses

The City of Fayetteville maintains protection zones between churches and certain other commercial uses. For example, a Sexually Oriented Business may not be operated within 500 feet of a church [Section 163.11]. Furthermore, a Retail Liquor Store cannot be located within the distance established by state law from any church or schoolhouse [Section 164.18].

Building and Safety

Fayetteville requires that construction documents and plans for Use Unit 4 structures (including churches) be retained on file permanently and not destroyed, even after construction is complete [Section 173.02].
