Measurement Rules and Regulatory Nuances

Frontage Measurement

For most street types in the City of Charlotte, the frontage setback is measured from the "future back of curb." If there is currently no curb, the measurement is taken from the curb location specified for the "Industrial Local Street Cross Section" in the Charlotte Land Development Standards Manual (CLDSM) [Section 8.3.C.1].

Setback Encroachments

The City of Charlotte Unified Development Ordinance permits certain architectural features and structures to encroach into required setbacks.

  • Accessory Structures: Generally, accessory structures in a residential context must be set back at least three feet from a side or rear lot line. However, if an accessory structure reaches a height of 24 feet or more, it must be set back at least 15 feet from the rear lot line [Section 17.1.E.2].
  • Mechanical Equipment: In the ML-1 district, ground-mounted mechanical equipment may be located in an established side or rear setback. If the equipment is visible from a frontage or an abutting Neighborhood 1 Place Type, it must be screened by a decorative wall or fence [Section 17.2.F.2.b].
  • Fences and Walls: In the City of Charlotte, a fence or wall located in an established setback along a frontage (excluding limited access frontages) is limited to a maximum height of eight feet. If the fence or wall is higher than three feet, it must be at least 75% open [Section 17.2.D.3.a].

Exceptions for Existing Facilities

If a nonconforming parking lot in the City of Charlotte ML-1 district is reconstructed by 50% or more, it must be brought into compliance with current setback and design requirements [Section 19.6.F].
