Specific Use Standards for Retail Storefronts

When a cannabis-related business operates as a Retail Goods Establishment, the City of Charlotte applies different standards based on the intensity of the district:

Commercial and Center Districts

In the CG General Commercial, CR Regional Commercial, NC Neighborhood Center, and RAC Regional Activity Center districts, retail uses are permitted by-right. However, in the CR Zoning District, if a new office use is established after June 1, 2023, it is limited to a maximum of 40% of the cumulative building gross floor area on the site [Section 15.4.JJJ.1].

Campus and Office Districts

In the IC-1 Institutional Campus and IC-2 Institutional Campus districts, a Retail Goods Establishment must be located on the ground floor of a multi-story building and have a formal affiliation with the primary institution of the campus it serves [Section 15.4.XXX.1]. In the OFC Office Flex Campus and OG General Office districts, these establishments are limited to 40% of the ground floor of a multi-story building [Section 15.4.XXX.2].

Neighborhood Districts (N1 and N2)

In the Neighborhood 1 (N1-A through N1-F) and Neighborhood 2 (N2-A through N2-C) districts, retail uses are only permitted as a Neighborhood Commercial Establishment. These are subject to strict limitations:

  • Existing Structures: In the City of Charlotte Neighborhood 1 and Neighborhood 2 Zoning Districts, these establishments are allowed only within structures that were nonresidential in their original construction or use as of June 1, 2023 [Section 15.4.III.1].

Standards for Delivery and Distribution

If the business model focuses on delivery, the City of Charlotte regulates the "hub" or storage site based on its logistics intensity:

  • Warehouse and Distribution Centers: This use is intended for larger-scale storage and movement of goods. It is permitted by-right only in the ML-1 and ML-2 Manufacturing and Logistics Zoning Districts [Table 15-1].
  • Office Use for Delivery: If the site is primarily for administration and dispatching drivers, it is considered an Office. While permitted in most commercial districts, in Neighborhood 1 and Neighborhood 2, an office is only permitted as a Neighborhood Commercial Establishment [Section 15.4.JJJ.4].
