Enforcement and Penalties for Zoning Violations in the City of Charlotte

Jurisdiction: CharlotteCode Version: June 01, 2023 (Amended March 23, 2026)

If a property owner or developer constructs a structure or initiates a land use that violates the City of Charlotte Unified Development Ordinance, the City may issue a Notice of Violation (NOV) requiring correction within a specific period, typically 10 to 30 days. Failure to comply can result in escalating civil penalties starting at $50 per day, the issuance of a stop-work order, the withholding of certificates of occupancy, or legal injunctions [Section 39.2.A]. Specialized violations involving heritage trees, floodplains, or soil erosion may incur significantly higher daily fines reaching up to $5,000 or criminal misdemeanor charges [Section 39.2.F, Section 39.2.J].

Inspection and Notice of Violation

The City of Charlotte administrative staff has the authority to enter and inspect any premises, including land and buildings, at reasonable hours to determine if the development complies with the Unified Development Ordinance [Section 39.1.A.1]. If a violation is found, the designated administrator will issue a written Notice of Violation to the property owner or person in control of the land.

The Notice of Violation must:

  • Identify the specific nature of the violation.
  • Describe the measures necessary to achieve compliance.
  • Specify a date by which the violator must comply or remedy the situation.
  • Inform the person if a civil penalty will be assessed [Section 39.2.A.1.b].

Stop Work Orders

For substantial violations of the City of Charlotte zoning regulations or activities that endanger life or property, the City may issue a stop-work order [Section 39.2.A.4]. This order requires all specified work to cease immediately. Continuing work in defiance of a stop-work order is a Class 1 misdemeanor [Section 39.2.A.4.b].

Civil Penalties and Fines

The City of Charlotte uses a tiered system for civil penalties. For general zoning violations related to Articles 3 through 22, the following fee structure applies:

Initial Citation $50
Second Citation (if not corrected) Up to $200
Third Citation Up to $500

Judicial Remedies and Abatement

In addition to financial penalties, the City of Charlotte may seek civil judicial remedies. This includes requesting the Mecklenburg County Superior Court to issue a mandatory or prohibitory injunction [Section 39.2.A.5.a]. The court may also issue an "order of abatement," which directs that buildings be closed or demolished, or that moving or other movable property be removed from the site to bring the property into compliance [Section 39.2.A.5.b].

Withholding and Revocation of Approvals

The City of Charlotte may withhold the issuance of a permit or a certificate of occupancy to prevent the unlawful erection or use of a building [Section 39.2.A.6.a]. Furthermore, a development approval or building permit may be revoked for any substantial departure from the approved application or for false statements made during the permitting process [Section 39.2.A.6.b].
