Drive-Through Business Regulations and Permitted Districts in Charlotte

Jurisdiction: CharlotteCode Version: June 01, 2023 (Amended March 23, 2026)

The City of Charlotte permits drive-through establishments as principal uses exclusively in the CG (General Commercial) and CR (Regional Commercial) zoning districts. While accessory drive-throughs are authorized in a broader range of districts, including various Center, Campus, and Transit-Oriented zones, they are generally prohibited from new construction outside of Commercial and Manufacturing districts unless the drive-through was already operational on June 1, 2023. All drive-through facilities in the City of Charlotte must adhere to strict site standards, including the provision of "bail-out" lanes and specific vehicle stacking minimums based on the type of business.

Permitted Zoning Districts for Drive-Throughs

The City of Charlotte distinguishes between "Drive-Through Establishments" (as a principal use of the lot) and "Accessory Drive-Throughs" (serving a primary use like a restaurant or bank).

Use Type Permitted Zoning Districts in the City of Charlotte
Drive-Through Establishment (Principal Use) CG, CR
Accessory Drive-Through CG, CR, ML-1, ML-2, IC-1, IC-2, OFC, OG, RC, IMU, NC, CAC-1, CAC-2, RAC, UC, UE, TOD-UC, TOD-NC, TOD-CC, TOD-TR

Note: Most districts listed for Accessory Drive-Throughs are subject to a "Legacy Clause" (see below) that limits new installations [Section 15.6.A.6].

Prescribed Conditions and Site Design

In the City of Charlotte, all drive-through facilities must comply with specific prescribed conditions to mitigate impacts on traffic and the pedestrian environment.

Vehicle Stacking Requirements

The number of required stacking spaces varies depending on whether the drive-through is a principal establishment or an accessory use. Stacking spaces must be at least nine feet wide and 18 feet long [Section 15.4.CC.4].

Business Type Principal Use Stacking (CG, CR) Accessory Use Stacking (Other Districts)
Restaurant 8 spaces per lane/bay 6 spaces per lane/bay
All Other Uses 4 spaces per lane/bay 4 spaces per lane/bay

Bail-Out Lanes and Circulation

The City of Charlotte requires all drive-through lanes to have a "bail-out" capability, allowing vehicles to exit the drive-through queue without completing a transaction.

  • Width: The bail-out lane must be a minimum of ten feet wide.
  • Configuration: The lane must run parallel to the drive-through lane.
  • Exceptions: If a business has multiple drive-through lanes, the City of Charlotte only requires a bail-out lane for one of them [Section 15.6.A.5].

Siting and Orientation

To protect the aesthetic and pedestrian character of Charlotte neighborhoods, the following location rules apply:

  • Setbacks: Drive-through components (signs, lanes, windows) must be located to the rear or side of the building. They are prohibited in any required front or side setback [Section 15.4.CC.5].
  • Frontage Placement: Drive-through lanes and circulation may not be placed between the street and the front façade of a building. This restriction does not apply to the CG, CR, ML-1, or ML-2 districts [Section 15.6.A.4].
  • Residential Separation: In Center and Transit-Oriented districts, drive-through signs must be located at least 15 feet from any Neighborhood 1 Place Type [Section 15.4.CC.d].

The June 1, 2023 Legacy Clause

One of the most critical restrictions in the City of Charlotte UDO is the limitation on new accessory drive-throughs. For the majority of districts where they are listed as a permitted accessory use, a legacy rule applies:

  • Restricted Districts: IC-1, IC-2, OFC, OG, RC, IMU, NC, CAC-1, CAC-2, RAC, UC, UE, and all TOD (Transit-Oriented Development) districts.
  • Rule: In these districts, an accessory drive-through is only permitted if it was located and in operation on the specific site as of June 1, 2023 [Section 15.6.A.6].
  • Exempt Districts: This "existing use" restriction does not apply to the CG, CR, ML-1, or ML-2 districts, where new accessory drive-throughs may still be constructed.

Parking Standards for Drive-Throughs

The City of Charlotte applies a tiered parking system. The minimum number of off-street parking spaces required for a drive-through establishment depends on the district's assigned tier.

Tier Zoning Districts (Examples) Minimum Parking Requirement
Tier 1 ML-1, ML-2, IC-1, OFC, OG 1 space
Tier 2 CG, CR, NC, CAC-1 1 space
Tier 3 RAC, UC, UE, TOD Districts, CAC-2 2 spaces
