Side and Rear Setback Requirements

The side and rear setbacks for the TOD-NC: Transit Neighborhood Center Zoning District are dependent upon the adjacent land use classification, specifically whether the neighboring property is a Neighborhood 1 Place Type.

Measurement and Siting Rules

In addition to the specific distances listed above, the City of Charlotte applies several technical rules to development within the TOD-NC: Transit Neighborhood Center Zoning District:

  • Measurement Point: On most public and network-required private streets, the frontage setback is measured from the existing or future back of curb. If no curb exists, the measurement is taken from the curb location specified in the Residential Wide Cross Section in the Charlotte Land Development Standards Manual (CLDSM) [Table 13-1, Footnote 1].
  • Special Frontages: For frontages along transit stations, off-street public paths, or public parks, the setback is measured from the property line or right-of-way line. If a reservation for a future frontage is in place, the setback is measured from the edge of that reservation area [Table 13-1, Footnote 3].
  • Building Entries: The City of Charlotte mandates that no building entry may be located closer than six feet to an existing or proposed off-street public path or shared-use path [Table 13-1, Footnote 2].
  • Utility Conflicts: If a build-to zone or setback requirement in the TOD-NC District conflicts with a Charlotte Water easement, other utility easement, or overhead utility clearance, the required line must be established at the edge of the easement or the edge of the required clearance [Table 13-1, Footnote 4].
  • Buffer Setbacks: Setbacks must be located at or behind any required pedestrian/bicycle facilities and planting strips or amenity zones as established by the City of Charlotte [Section 2.3].
