Charlotte Zoning Regulations for Restaurants, Cafes, and Bakeries
In the City of Charlotte, restaurants and cafes are primarily categorized as "Restaurant/Bar" or "Specialty Food Service," with the latter specifically covering businesses like coffee roasters and bakeries that prepare food on-site. These uses are permitted in nearly every zoning district, though they are subject to "Prescribed Conditions" (PC) in residential and campus areas to ensure compatibility with neighbors. Notably, while these uses are allowed in the Neighborhood 1 and Neighborhood 2 Zoning Districts, they must be part of a "Neighborhood Commercial Establishment," which limits their size and placement to specific types of structures or corner lots [Section 15.2].
Permitted Zoning Districts
The City of Charlotte Unified Development Ordinance (UDO) manages food-related businesses under two primary use definitions. The table below outlines where these uses are permitted by-right (X), allowed with prescribed conditions (PC), or prohibited (shaded/blank).
Table 1: Use Matrix for Food Service
| Zoning District Category | Restaurant / Bar | Specialty Food Service |
|---|---|---|
| Neighborhood 1 (N1-A to N1-F) | PC | PC |
| Neighborhood 2 (N2-A to N2-C) | PC | PC |
| Commercial (CG, CR) | PC | X |
| Campus (IC-1, IC-2, OFC, RC) | PC | PC (X in RC) |
| Manufacturing & Logistics (ML-1, ML-2) | PC | X |
| Innovation Mixed-Use (IMU) | PC | X |
| Neighborhood Center (NC) | PC | X |
| Community Activity Center (CAC-1, CAC-2) | PC | X |
| Regional Activity Center (RAC, UC, UE) | PC | PC |
| Transit Oriented Development (TOD-UC, NC, CC, TR) | PC | X |
Note: In the City of Charlotte, "PC" indicates the use must comply with specific standards found in Article 15.4 to mitigate impacts on adjacent properties [Section 15.2.B].
Use Definitions in the City of Charlotte
The City of Charlotte distinguishes between general dining and food production with retail components:
- Restaurant/Bar: An establishment where food and/or alcoholic beverages are provided to the public for on-premises consumption or carry-out service [Section 15.3].
- Specialty Food Service: A facility including preparation, processing, or packaging of food products (such as a coffee roaster, candy maker, or bakery). These must be completely enclosed with no outside impacts and must offer on-site retail sales or restaurant service [Section 15.3].
Prescribed Conditions for Approval
When a restaurant or cafe is marked as "PC" in the Use Matrix, it must adhere to the following City of Charlotte standards:
General Requirements (All Districts)
- Hours and Enclosure: Incidental entertainment is permitted only within a permanent enclosed area. All windows and doors must remain closed between 11:00 PM and 8:00 AM [Section 15.4.WWW].
- Campus Limits: In the IC-1 and IC-2 Institutional Campus Zoning Districts, the business must have a formal affiliation with the primary institution (e.g., a hospital or university) and cannot exceed 10% of the total gross floor area of the building it occupies [Section 15.4.WWW].
Neighborhood Commercial Establishments (N1 and N2 Districts)
In the Neighborhood 1 and Neighborhood 2 Zoning Districts, new restaurants, cafes, and bakeries are restricted to specific configurations:
- Existing Structures: They may occupy nonresidential structures that existed as of June 1, 2023, but these structures cannot be expanded [Section 15.4.III.1].
- Neighborhood 2 New Construction: In the Neighborhood 2 Zoning District, these uses are allowed on the ground floor of multi-family stacked dwellings [Section 15.4.III.2].
- Freestanding Rules: In the Neighborhood 2 Zoning District, a new freestanding restaurant is permitted only if it is on a corner lot, does not exceed 9,000 square feet, and is no taller than 48 feet [Section 15.4.III.3].
- Alcohol Prohibition: The sale of alcohol is strictly prohibited for these establishments when located within any Neighborhood 1 Zoning District [Section 15.4.III.5].
Off-Street Parking Requirements
The City of Charlotte applies different parking standards based on a "Tier System" tied to the intensity of the district.
Table 2: Minimum Vehicle Parking Ratios
| Use Type | Tier 1 (N1, N2-A, ML, IC-1, OFC, OG) | Tier 2 (N2-B/C, IMU, IC-2, RC, NC, CAC-1, CG, CR) | Tier 3 (Activity Centers & TOD) |
|---|---|---|---|
| Restaurant / Bar | 1 space per 750sf GFA + 50% of outdoor seating area | 1 space per 1,000sf GFA + 50% of outdoor seating area | No minimum (Max. limits apply) |
| Specialty Food Service | 1 space per 750sf GFA | 1 space per 1,000sf GFA | No minimum (Max. limits apply) |
*GFA = Gross Floor Area. In Tier 3 districts, like the Uptown Core (UC), the City of Charlotte often removes minimum requirements to encourage transit use [Article 19.2].*
Accessory Drive-Throughs
In all City of Charlotte districts except Commercial and Manufacturing/Logistics, a drive-through for a restaurant or bakery is only allowed if it was already in operation on the site as of June 1, 2023. For new installations in eligible districts, the restaurant must have at least 24 seats (indoor or outdoor) [Section 15.6.A].
